August 7 2006

MONDAY, AUGUST 7, 2006

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.

 

Council President Newlove declared the minutes of the meeting held July 17, 2006 approved as distributed.

 

 

CORRESPONDENCE

 

            There was no correspondence.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn requested confirmation of the following appointments to City Boards and Commissions:

 

·         Brad Biller – Human Relations Commission for a term expiring 5/31/07;

·         Brad Biller – Taxicab License Board – indefinite term.

 

Council Member Sorrells moved, Frost seconded, to approve the appointments as presented by the Mayor.  On unanimous voice vote, Council President Newlove declared motion carried.

 

            Mayor Quinn presented a Certificate of Appreciation to Pastor Chris Young for her dedicated service on the Human Relations Commission from February, 2004 until May, 2006.

 

            Mayor Quinn commented that Council has legislation before them tonight that will make changes to the terms of the Bicycle Safety Commission so that all the terms on that commission do not expire at the same time.  Mayor Quinn noted that similar changes are being made to the Transportation Advisory Committee but legislation is not required to make those changes.  Mayor Quinn asked Council President Newlove to have a council committee look at and review the term limit requirement for City Boards and Commissions.

 

            Municipal Administrator John Fawcett announced that the City will be participating in the “National Stop on Red Week” this week by placing message boards at the four entry points to the city in order to emphasize this public safety issue.

 

            Fawcett also reported that the Transportation Advisory Committee will be meeting on Monday, August 14, at 5:15 p.m. in the Council Chamber to discuss a proposed fare hike.  Fawcett noted that if approved the rate will rise from $2.50 to $3.50 per ride and from $1.25 to $1.75 for the elderly and handicapped.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Director Michelle Grigore had no report.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard had no report.

         

  

Public Works Director Bill Blair reported to Council regarding upcoming bid openings for projects and noted that unlimited heavy item pick up is being performed this week throughout the city.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Heminger, for the Public Lands and Buildings Committee, introduced an ordinance authorizing the Municipal Administrator to seek proposals and enter into a contract or contracts for professional cleaning services for the City Administrative Services Building and the Municipal Court Building.

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance amending and adopting Section 30.116(B) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding the Bicycle Safety Commission.

 

            Council Member Tomashefski, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator and the Utilities Director to sell obsolete items no longer needed for municipal purposes by public auction, and declaring an emergency.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance establishing interim zoning of I-1 Institutional zoning for the approximately 42.016 acres of land on Gorrill Road recently annexed to the City of Bowling Green, Ohio, by the Bowling Green Church of the Nazarene.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending and adopting Section 150.21 of the Codified Ordinances of the City of Bowling Green, Ohio, concerning the maximum height limit in M-1 Districts.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending Ordinance #6842 with respect to the S-District Site Plan for the P & D Development on Klotz Road.

 

 

COUNCIL COMMITTEE REPORTS

 

            There were no Council committee reports.

 

 

LOBBY VISITATIONS

 

            William Feeman, 1301 S. Orleans, addressed Council asking that stop signs be included in the “National Stop on Red Week” campaign.  Municipal Administrator John Fawcett responded that the intention of the campaign was that it applied to all kinds of traffic stop devices.

 

 

READING OF LEGISLATION

 

            Clerk read Ordinance #7591 authorizing the Municipal Administrator to seek proposals and enter into a contract or contracts for professional cleaning services for the City Administrative Services Building and the Municipal Court Building, for first reading.

            Clerk read Resolution #3310 authorizing the Mayor of the City of Bowling Green, Ohio, to file an application(s) with the Ohio Department of Transportation for grants through the US DOT Federal Transit Administration (FTA), as authorized under Federal Transit Laws, as Codified, 49 USC, Section 5311, Financial Assistance for other than urbanized areas and funds available from the Ohio Public Transportation Grant Program and executing a contract with the Ohio Department of Transportation upon grant application approval, for second reading.

 

            Clerk read Ordinance #7583 amending and adopting Section 38.02(A) and Section 38.14 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding civil infractions, and declaring an emergency, for second reading.

 

            Council Member Frost moved, Tomashefski seconded, to suspend the rules and give Ordinance #7583 its third reading.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Frost voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Ordinance #7583 for third reading by number and title only.

 

            Council Member Frost moved, Tomashefski seconded, to adopt the emergency clause for Ordinance #7583.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Frost moved, Zanfardino seconded, to adopt Ordinance #7583.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7583 adopted.

 

            Clerk read Ordinance #7585 amending and adopting Section 33.21 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to personal business leave, for second reading.

 

            Clerk read Ordinance #7586 adopting Section 33.03(C) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to pay for School Police, Interns, and Civil Infractions Hearing Officer, for second reading.

            Council Member Zanfardino moved, McOmber seconded, to adopt Ordinance #7573.  On roll call vote, Council Members Sorrells, Tomashefski, Zanfardino, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7573 adopted.

 

            Clerk read Ordinance #7576 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for an in-ground irrigation system at Simpson Garden Park, for third reading.

 

            Council Member Tomashefski moved, Heminger seconded, to adopt Ordinance #7576.  On roll call vote, Council Members Tomashefski, Zanfardino, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7576 adopted.

 

            Clerk read Ordinance #7578 amending and adopting Section 33.23(B) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to medical and dental insurance, for third reading.

 

            Council Member Tomashefski moved, Zanfardino seconded, to adopt Ordinance #7578.  On roll call vote, Council Members Zanfardino, Frost, Heminger, McOmber, Newlove, Sorrells, and Tomashefski voted yes.  Council President Newlove declared motion carried, and Ordinance #7578 adopted.

 

            Clerk read Ordinance #7579 amending and adopting Chapter 97 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding parks, for third reading.

 

            Council Member Newlove moved, Frost seconded, to adopt Ordinance #7579.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7579 adopted.

 

            Clerk read Ordinance #7580 accepting annexation of approximately 3.15 acres of land in Center Township, Wood County, Ohio, from Monte A. & Rebecca C. Davenport, petitioners, for third reading.

 

            Council Member Frost moved, Heminger seconded, to adopt Ordinance #7580.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7580 adopted.

 

            Clerk read Ordinance #7581establishing interim zoning of R-2 Single Family Residential zoning for the approximately 3.15 acres of land located at 11367 Napoleon Road, owned by Monte A. & Rebecca C. Davenport, and recently annexed to the City of Bowling Green, for third reading.

 

            Council Member Frost moved, McOmber seconded, to adopt Ordinance #7581.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7581 adopted.

 

Council Member Frost moved, Sorrells seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the August 7, 2006 regular meeting of the City Council at 8:30 p.m., subject to call.
