The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Mura. The meeting began with the Pledge of Allegiance.
On roll call, Council Members Frost, Heminger, McOmber, Mura, Newlove, Sorrells and Zanfardino responded. Also present were Mayor John Quinn, Utilities Director Kevin Maynard, City Attorney Michael Marsh and Planning Director Rick Ketzenbarger. Municipal Administrator John Fawcett, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair were not present.
Council Member Sorrells noted that throughout the minutes of the January 17, 2006 meeting references are made to his attendance at the council meeting. Sorrells noted that he was absent from the January 17 meeting and asked that these references be corrected. Council President Mura declared the minutes of the meeting held January 17, 2006 approved as corrected.
CORRESPONDENCE
Clerk read into the record a letter from Council President Mura resigning his position on City Council effectively February 7, 2006. The letter indicated that Mr. Mura accepted a job in Columbus, Ohio and must start immediately.
OFFICIAL REPORTS
Mayor John Quinn reported that he a Municipal Administrator John Fawcett are continuing their annual visits to manufacturing facilities in Bowling Green and have been pleased to have newly elected Council Members Sorrells and McOmber accompany them on these visits.
Mayor Quinn noted that he does not intend to send letters to local bar owners this year regarding opening early on St. Patrick’s Day. Quinn indicated that the City received some cooperation in the past and it is hoped that those establishments will continue to honor the request. Quinn also indicated that he intends to personally contact those who have not cooperated in the past in hopes to gain their cooperation.
Mayor Quinn noted that legislation is being presented to Council this evening authorizing the Municipal Administrator to enter into a contract with Santa Rita Collaborative for consulting services relating to the Bowling Green Area Community Partnership. Quinn explained that this partnership includes the university and the Bowling Green local school district; each partner is putting in $12,000 of the $36,000 fee for the contract. Quinn commented that it is hoped that the development of this partnership will increase the number of citizens involved in the process of making decisions that effect the community and open lines of communication between the parties involved so that situations may be handled with civility. Quinn asked Council to give the legislation all three readings and enact the emergency clause in order to begin work immediately.
Utilities Director Kevin Maynard reviewed four legislative items that were tabled at the last meeting for the benefit of newly elected Council Members. Maynard requested that Ordinance #7521 be tabled indefinitely while new details of the power purchase are being considered. Maynard noted that this issue will go back to the Board of Public Utilities for their approval prior to any action taken by Council.
NEW LEGISLATION
Council Member Heminger, for the Public Lands and Buildings Committee, introduced an ordinance authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for the interior painting of the Police Division Facility located at 175 West Wooster Street, and declaring an emergency.
Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance authorizing the Municipal Administrator to enter into a contract with Santa Rita Collaborative, without advertising and bidding, for consultative services relating to the Bowling Green Area Community Partnership, and declaring an emergency.
Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance amending and adopting Sections 99.19, 99.21(A), and 94.28 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding noxious weeds.
Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance accepting annexation of approximately 1.54 acres of land in Plain Township, Wood County, Ohio, from Terry L. & Carolyn Waltz, petitioners.

LOBBY VISITATIONS
Phineas Anderson, 230 Mulberry Street, Perrysburg, Ohio, addressed Council regarding a recent request that Council consider enacting a resolution to support government action to prevent nuclear terrorism. Mr. Anderson indicated that the cities of Perrysburg, Maumee, Sylvania and Toledo are among Ohio cities who have enacted similar legislation.
Maria Khoury introduced herself as the BGSU Undergraduate Student Government (USG) liaison between the university and the city administration. Ms. Khoury noted that the USG is in the process of creating a relations board and that Council Members Heminger, Zanfardino, and Newlove have been asked to join.

Council Member McOmber moved, Frost seconded, to adopt Ordinance #7518 authorizing the Utilities Director to execute a mutual aid agreement with interstate and intrastate participating municipalities with municipal electric systems. On roll call vote, Council Members Sorrells, Zanfardino, Frost, Heminger, McOmber, Mura, and Newlove voted yes. Council President Mura declared motion carried, and Ordinance #7518 adopted.
Council Member McOmber moved, Newlove seconded, to adopt Ordinance #7519 authorizing the Utilities Director to execute a generic mutual aid agreement prepared by the American Public Power Association (APPA), National Rural Electric Cooperative Association (NRECA), and the Federal Emergency Management Agency (FEMA). On roll call vote, Council Members Zanfardino, Frost, Heminger, McOmber, Mura, Newlove, and Sorrells voted yes. Council President Mura declared motion carried, and Ordinance #7519 adopted.
Council Member McOmber moved, Heminger seconded, to adopt Ordinance #7520 amending and adopting certain revisions to Chapter 50 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to sewer service and the Wastewater Treatment Plant and sewage collection system pre-treatment plan. On roll call vote, Council Members Frost, Heminger, McOmber, Mura, Newlove, Sorrells and Zanfardino voted yes. Council President Mura declared motion carried, and Ordinance #7520 adopted.
Council Member McOmber moved, Newlove seconded, to table indefinitely Ordinance #7521 authorizing the Utilities Director to execute a long-term power supply agreement with American Municipal Power-Ohio, Inc., for 6.5 MW of the J. Aron & Company power purchase. On roll call vote, Council Members Heminger, McOmber, Mura, Newlove, Sorrells, Zanfardino, and Frost voted yes. Council President Mura declared motion carried, and Ordinance #7521 tabled indefinitely.
Council Members moved, Heminger seconded, to move Council into Executive Session at 8:50 p.m. for the purpose of discussing land acquisition. On roll call vote, Council Members McOmber, Mura, Newlove, Sorrells, Zanfardino, Frost, and Heminger voted yes. Council President Mura declared motion carried.
Council Members moved, Newlove seconded, to move Council out of Executive session at 9:25 p.m. On roll call vote, Council Members Mura, Newlove, Sorrells, Zanfardino, Frost, Heminger, and McOmber voted yes. Council President Mura declared motion carried.
Council Member Sorrells moved, Newlove seconded, to adjourn. On unanimous voice vote, Council President Mura adjourned the February 6, 2006 regular meeting of the City Council at 9:26 p.m., subject to call.
