MONDAY, DECEMBER 17, 2007

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, McOmber, Newlove, Sorrells, and Zanfardino responded.  Council Member Heminger was not present.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.

 

Council President Newlove declared the minutes of the meeting held December 3, 2007 approved as distributed.

 

 

CORRESPONDENCE

 

            Clerk noted that a listing of budget transfers for the month of December was received from Finance Director Brian Bushong and distributed to Council prior to the meeting for approval.  Council Member McOmber moved, Sorrells seconded, to approve the transfers as presented.  On unanimous voice vote, Council President Newlove declared motion carried.  A copy of the transfers is attached and made a part of these minutes.

 

            Clerk noted that copies of the Budget Summary Report for the month of November, 2007 was distributed to Council prior to this evening’s meeting.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn announced that Judge Mark Reddin will be present at the January 7, 2008 meeting of Council to swear in newly elected Council Members.

 

            Mayor Quinn also announced that the annual Martin Luther King, Jr. celebration will be held on Friday, January 18, at 1:30 p.m. at the Wood County Library Atrium.  Featured speaker will be BGSU President, Sidney Ribeau.

 

            Mayor Quinn also announced that the annual State of the City address is scheduled for Tuesday, February 12, 2008, at 8:00 a.m. also at the Wood County Library Atrium.

 

            Municipal Administrator John Fawcett clarified snow emergency procedures for the City.  Fawcett introduced Fire Chief Meredith who reported that recently hired firefighter, Ronald Clausen, graduated from the Ohio Fire Academy as the top student in both the EMT and fire classes.  Chief Meredith noted that it was his pleasure to be in attendance at the Clausen’s graduation in Columbus.

 

            Fawcett also introduced Police Chief Gary Spencer who reported that Lt. Tony Hetrick recently graduated from the 231st session of the FBI Academy.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Director Michelle Grigore had no report.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard had no report.

 

            Public Works Director Brian Craft pointed out to Council Members that a new aerial photograph has been placed on the wall in the Council Chamber.  Craft also reported that 500 tons of salt and 466 hours of labor were used in the recent snow storm.  Craft noted that leaf pickup has been delayed by the snowfall but will resume once the snow has melted.  Craft also reported that heavy item pickup will be done the week of December 24 on the east side of Main Street and the week of December 31 on the west side of Main Street.

 

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2007 and ending December 31, 2007.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance establishing the uniform tap fee of $40.00 per front foot for construction of the East Gypsy Lane Road/Klotz Road sewer improvement project.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to enter into a contract or contracts for the performance of a water distribution study.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to enter into a contract or contracts for the purchase and installation of an Advanced Metering Infrastructure (AMI) System with Distribution Control Systems, Inc., and H.D. Supply Utilities, Ltd., and Badger Meter, Inc., and ValuTech Solutions.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending Section 150.55(C) of the Codified Ordinances of the City of Bowling Green, Ohio, with respect to the parking of recreational vehicles.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending the Zoning District Map of the City of Bowling Green, Ohio, for approximately 0.36 acres of land on West Wooster Street from R-2 Residential zoning to S-3 Planned Institutional zoning as petitioned for by Wood County Hospital.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance approving the S-District Site Plan with waivers for the Wood County Hospital.

READING OF LEGISLATION

 

            Clerk read Resolution #3356 transferring previously appropriated funds, for first reading.

 

            Council Member Newlove moved, Dunn seconded, to suspend the rules and give Resolution #3356 its second and third reading. On roll call vote, Council Members  Frost, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3356 for second and third reading by number and title only.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Resolution #3356.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Resolution #3356 adopted.

 

 

 

            Clerk read Ordinance #7732 providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2007 and ending December 31, 2007, for first reading.

 

            Council Member Newlove moved, Sorrells seconded, to suspend the rules and give Ordinance #7732 its second and third reading.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, and McOmber voted yes.  Council President Newlove declared motion carried, and rules suspended.

            Clerk read Resolution #3353  approving and adopting the Drug and Alcohol Testing Policy for the BG Transit as recommended by the Transit Advisory Committee, for second reading.

 

            Clerk read Resolution #3354 authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and enter into an agreement with the Ohio Department of Natural Resources for the purpose of acquiring financial assistance from the Recreational Trails Program, for second reading.

 

            Clerk read Resolution #3355 authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and enter into an agreement with the Ohio Department of Natural Resources for the purpose of acquiring financial assistance from the Natureworks Program, for second reading.

  

            Clerk read Ordinance #7730 repealing Section 100.01 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to dense smoke emission regulations, for second reading.

 

            Clerk read Ordinance #7731 to provide appropriations for the expenses and other expenditures of the City of Bowling Green, Ohio, for the fiscal year beginning January 1, 2008 and ending December 31, 2008, for second reading.

 

            Council Member Newlove moved, Dunn seconded, to suspend the rules and give Ordinance #7731 its third reading.  On roll call vote, Council Members Zanfardino, Dunn, Frost, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and rules suspended.

            Clerk read Ordinance #7720 authorizing the Municipal Administrator to enter into an agreement with the Bowling Green Recycling Center, Inc., for recycling services, for third reading.

 

            Council Member Zanfardino moved, McOmber seconded, to adopt Ordinance #7720.  On roll call vote, Council Members  Frost, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Ordinance #7720 adopted.

 

            Clerk read Ordinance #7722 creating and adopting Section 33.02 of the Codified Ordinances of the City of Bowling Green, Ohio, relative to classifications of employee appointments, for third reading.

 

            Council Member Newlove moved, Sorrells seconded, to adopt Ordinance #7722.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7722 adopted.

 

            Clerk read Ordinance #7723 amending and adopting Section 30.21 of the Codified Ordinances of the City of Bowling Green, Ohio, relative to bonds, for third reading.

 

            Council Member Newlove moved, Frost seconded, to adopt Ordinance #7723.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7723 adopted.

 

            Clerk read Ordinance #7724 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the construction of the low service pump and river intake improvements at the Water Treatment Plant, for third reading.

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7724.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7724 adopted.

 

            Clerk read Ordinance #7725 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for water main improvements on North Enterprise Street, North Main Street, and South Prospect Street, for third reading.

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7725.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7725 adopted.

 

            Clerk read Ordinance #7726 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the Napoleon Road sewer improvements, for third reading.

  

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7726.  On roll call vote, Council Members Dunn, Frost, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7726 adopted.

 

            Clerk read Ordinance #7727 authorizing the Utilities Director to accept a utility easement from the Union Bank Company, for third reading.

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7727.  On roll call vote, Council Members  Frost, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Ordinance #7727 adopted.

 

            Clerk read Ordinance #7728 authorizing the Utilities Director to accept a utility easement from Robert W. & Patricia A. Maurer for certain areas in the Bentwood Subdivision, Plat III, for third reading.

 

            Council Member McOmber moved, Sorrells seconded, to adopt Ordinance #7728.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7728 adopted.

 

            Clerk read Ordinance #7729 authorizing the Utilities Director to accept a utility easement from American Title Agency, Inc., Trustee, for an area located in the Waterside Bowling Green Subdivision, Phase I, for third reading.

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7729.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, and McOmber voted yes.  Council Member Newlove abstained.  Council President Newlove declared motion carried, and Ordinance #7729 adopted.

 

            Council Member Dunn moved, Zanfardino seconded, to excuse Council Member Heminger from this evening’s meeting.  On unanimous voice vote, Council President Newlove declared motion carried.

 

Council Member McOmber moved, Sorrells seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the December 17, 2007 regular meeting of the City Council at 8:40 p.m., subject to call.
