MONDAY, DECEMBER 3, 2007

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.  Michelle Fitzgerald was sworn in as Acting Clerk of Council by City Attorney Michael Marsh.

 

On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.

 

Council President Newlove declared the minutes of the meeting held November 19, 2007 approved as distributed.

 

 

CORRESPONDENCE

 

            Acting Clerk noted that the following three applications were received from the Ohio Division of Liquor Control:

 

·         Class D5I permit for Gladieux Enterprises, Inc., dba Memorial Hall Anderson Arena, located at 1001 E. Wooster Street, Bowling Green;

·         Class D5I permit for Gladieux Enterprises, Inc., dba Ice Arena, located at 417 Mercer Road, Bowling Green;

·         Class C2 permit for Speedway Beverage LLC, dba Speedway #5253 located at 1650 E. Wooster Street, Bowling Green.

 

Acting Clerk also noted for the record that as required by the Ohio Revised Code, the Probation Services Fund report was received from the Municipal Court.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn reported that the Community Partnership group started two years ago will continue to pursue its course, however, the three funding partners are no longer funding the endeavor.  Mayor Quinn noted that it was always intended that the group would become self-sustaining.  The group’s next meeting is scheduled for January 16.

 

            Municipal Administrator John Fawcett invited those Council Members that are attending tomorrow’s Open Records training in Toledo to meet at the City Building around 8:00 a.m. for transportation to the training session.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Director Michelle Grigore invited the community to attend the  “Simpson by Candlelight” event that will be held this Thursday from 6:30 p.m. – 8:30 p.m.  Grigore noted that 500 luminaries will be lighting the park and there will be a visit by Mr. and Mrs. Santa Claus. 

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard had no report.

 

            Public Works Director Brian Craft reported that crews are currently working in the 4th ward picking up leaves.  One more pass throughout the city is still planned for the purpose of picking up leaves.  Craft also noted that heavy item trash pickup will be held the week of Dec. 24 on the east side of Main Street and the week of Dec. 31 on the west side.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution approving and adopting the Procurement Manual for use with the Housing Revolving Loan fund and the Community Development Block Grant Fund.

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution approving and adopting the Drug and Alcohol Testing Policy for the BG Transit as recommended by the Transit Advisory Committee.

 

            Council Member Dunn, for the Parks and Recreation Committee, introduced a resolution authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and enter into an agreement with the Ohio Department of Natural Resources for the purpose of acquiring financial assistance from the Recreational Trails Program.

 

            Council Member Dunn, for the Parks and Recreation Committee, introduced a resolution authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and enter into an agreement with the Ohio Department of Natural Resources for the purpose of acquiring financial assistance from the Natureworks Program.

 

            Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance to provide appropriations for the expenses and other expenditures of the City of Bowling Green, Ohio, for the fiscal year beginning January 1, 2008 and ending December 31, 2008.

 

            Council Member Sorrells, for the Transportation and Safety Committee, introduced an ordinance repealing Section 100.01 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to dense smoke emission regulations.

 

 

COUNCIL COMMITTEE REPORTS

 

            There were no Council committee reports.

 

 

LOBBY VISITATIONS

 

            Marissa McCarthy, community outreach chair of the University’s annual Dance Marathon, addressed Council regarding the upcoming event to be held March 29 & 30, 2008.  Ms. McCarthy commented that the Dance Marathon members are trying to get the community involved with the fundraiser that benefits Children’s Miracle Network.

 

 

READING OF LEGISLATION

 

            Acting Clerk read Resolution #3351 transferring previously appropriated funds, for first reading.

 

            Council Member Newlove moved, Heminger seconded, to suspend the rules and give Resolution #3351 its second and third reading.  On roll call vote, Council Members  Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Acting Clerk read Resolution #3351 for second and third reading by number and title only.

 

            Council Member Newlove moved, Sorrells seconded, to adopt Resolution #3351.   On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Resolution #3351 adopted.

  

            Acting Clerk read Resolution #3352 approving and adopting the Procurement Manual for use with the Housing Revolving Loan fund and the Community Development Block Grant Fund, for first reading.

            Acting Clerk read Ordinance #7724 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the construction of the low service pump and river intake improvements, for second reading.

 

            Acting Clerk read Ordinance #7725 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for water main improvements on North Enterprise Street, North Main Street, and South Prospect Street, for second reading.

 

            Acting Clerk read Ordinance #7726 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the Napoleon Road sewer improvements, for second reading.

            Acting Clerk read Ordinance #7729 authorizing the Utilities Director to accept a utility easement from American Title Agency, Inc., Trustee, for an area located in the Waterside Bowling Green Subdivision, Phase I, for second reading.

 

            Acting Clerk read Ordinance #7719 amending and adopting Section 32.07 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to requests for and establishing fees for copies of public records, for third reading.

 

 

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7719.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7719 adopted.

 

Council Member Dunn moved, Sorrells seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the December 3, 2007 regular meeting of the City Council at 8:24 p.m., subject to call.
