MONDAY, OCTOBER 15, 2007
The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove. The meeting began with the Pledge of Allegiance.
On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded. Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.
Council President Newlove declared the minutes of the meeting held October 2, 2007 approved as distributed.
CORRESPONDENCE
Clerk noted that a listing of budget transfers for the month of October was received from Finance Director Brian Bushong and distributed to Council prior to the meeting for approval. Council Member Heminger moved, Frost seconded, to approve the transfers as presented. On unanimous voice vote, Council President Newlove declared motion carried. A copy of the transfers is attached and made a part of these minutes.
Clerk noted that copies of the Budget Summary Report for the month of September, 2007 was distributed to Council prior to this evening’s meeting.
OFFICIAL REPORTS
Mayor John Quinn requested confirmation of the appointment of Council Member Sorrels to the Convention & Visitors Bureau for a two-year term. Council Member Dunn moved, McOmber seconded, to approve the appointment as presented by the Mayor. On unanimous voice vote, Council President Newlove declared motion carried.
Mayor Quinn announced that the Community Reads program kicks off Thursday, October 24, at the Wood County Library and invited everyone to attend. Quinn noted that this year’s book is The Glass Castle by Jeannette Walls.
Municipal Administrator John Fawcett reported that there is a new public records training that is required for Council Members to attend one time during each term of office in which they serve. Fawcett noted that there is a session being held on December 4 at 9:00 a.m. at Owens Center for the Performing Arts and asked interested Council Members to let Clerk of Council Kay Scherreik now if they plan to attend.
Fawcett requested an Executive Session at the end of this evening’s meeting to discuss a land acquisition issue.
Planning Director Rick Ketzenbarger was not present.
Parks and Recreation Director Michelle Grigore had no report.
City Attorney Michael had no report.
Utilities Director Kevin Maynard had no report.
Public Works Director Brian Craft welcomed Boy Scouts Tanner Engle and John Hoover to this evening’s meeting. Craft reported that brush pickup has been completed in the Fourth Ward and they have moved on to the Third Ward. Craft also reported that the street striping is just about finished up and work has begun on redoing the landscaping in front of the City building.
NEW LEGISLATION
The following new legislation was recommended by the Administration and presented to Council for introduction:
Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.
COUNCIL COMMITTEE REPORTS
There were no Council committee reports.
LOBBY VISITATIONS
Wendy Stram, Executive Director of the Bowling Green Convention & Visitors Bureau, reported to Council that as required by the current contract with the City, copies of the CVB’s strategic plan and the 2008 budget were distributed to Council. Ms. Stram highlighted CVB accomplishments over the past year and thanked the City for their continued financial support.
Bob Hudson, 229 Willowood Circle, addressed City Council seeking full city services for residents residing on Larch Landing’s private streets. Mr. Hudson reasoned that this development is different than others like it in that each homeowner owns the land on which their home are built.
READING OF LEGISLATION
Clerk read Resolution #3348 transferring previously appropriated funds, for first reading.
Council Member Newlove moved, Zanfardino seconded, to suspend the rules and give Resolution #3348 its second and third reading. On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes. Council President Newlove declared motion carried, and rules suspended.
Clerk read Resolution #3348 for second and third reading by number and title only.
Council Member Newlove moved, Frost seconded, to adopt Resolution #3348. On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes. Council President Newlove declared motion carried, and Resolution #3348 adopted.
Clerk read Ordinance #7709 creating and adopting Section 70.41 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to the storage of recreational vehicles at residences, for second reading.
Clerk read Ordinance #7710 amending and adopting Section 38.02(B) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to Class B Civil Offenses, for second reading.
Clerk read Ordinance #7711 authorizing the Utilities Director to apply for a loan and execute an agreement with the Ohio EPA Water Supply Revolving Loan Account and/or the Ohio Water Development Agency for the construction of the low service and river intake improvements, for second reading.
Clerk read Ordinance #7712 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the purchase of two sulfur hexafluoride circuit breakers for use at the Gypsy Lane Road Substation, for second reading.
Clerk read Ordinance #7713 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the inspection and cleaning of trunk sewers larger than 60 inches in diameter, for second reading.
Clerk read Ordinance #7714 authorizing the Utilities Director to execute a power sales contract with American Municipal Power-Ohio, Inc., and to take other actions in connection therewith for up to 35 megawatts of capacity from the Prairie State Energy Campus, for second reading.
Clerk read Ordinance #7715 authorizing the Utilities Director to execute a power sales contract with American Municipal Power-Ohio, Inc., and to take other actions in connection therewith for up to 20 megawatts of capacity from the AMP-Ohio Hydro System project, for second reading.
Clerk read Ordinance #7716 accepting an easement for right-of-way municipal purposes from Marilyn J. Beattie, Trustee, for second reading.
Clerk read Ordinance #7717 authorizing the Municipal Administrator to consent to a transfer of the assets of Noveon, Inc., to the newly named corporation “Lubrizol Advance Materials, Inc.”, for second reading.
Clerk read Ordinance #7708 amending the Zoning District Map of the City of Bowling Green, Ohio for approximately 1.2 acres of the property generally known as 500 Lehman Avenue from M-1 Light Industrial to B-4 Office District zoning, for third reading.
Council Member Frost moved, Heminger seconded, to table Ordinance #7708 until November 5, 2007 at which time a public hearing will be held regarding this ordinance. On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes. Council President Newlove declared motion carried, and Ordinance #7708 tabled until November 5, 2007.
Council Member Frost moved, Sorrells seconded, to move Council into Executive Session at 8:32 p.m. for the purpose of discussing land acquisition. On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes. Council President Newlove declared motion carried.
Council Member Frost moved, Sorrells seconded, to move Council out of Executive Session at 9:00 p.m. On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes. Council President Newlove declared motion carried.
Council Member McOmber moved, Sorrells seconded, to adjourn. On unanimous voice vote, Council President Newlove adjourned the October 15, 2007 regular meeting of the City Council at 9:01 p.m., subject to call.
