The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove. The meeting began with the Pledge of Allegiance.
On roll call, Council Members Dunn, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded. Council Member Frost was not present. Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.
Council President Newlove declared the minutes of the meeting held August 4, 2008 approved as distributed.
CORRESPONDENCE
Clerk reported that applications were received from the Ohio Division of Liquor Control for a transfer and a new liquor permit for Clazel Entertainment Limited, dba Clazel Entertainment, located at 129 N. Main Street. Clerk noted that a check of the records was requested and no detrimental information was noted.
Clerk noted that a listing of budget transfers for the month of August was received from Finance Director Brian Bushong and distributed to Council prior to the meeting for approval. Council Member Zanfardino moved, Sorrells seconded, to approve the transfers as presented. On unanimous voice vote, Council President Newlove declared motion carried. A copy of the transfers is attached and made a part of these minutes.
Clerk also noted that copies of the Budget Summary Report for the month of July, 2008 was distributed to Council prior to this evening’s meeting.
OFFICIAL REPORTS
Mayor John Quinn reported that he appointed Catharine Harned to the Transportation Advisory Committee. The Mayor noted that that appointment does not require confirmation by City Council.
Mayor Quinn presented Certificates of Appreciation to Paul Haas for his service on the Human Relations Commission from June 2005 to May 2008, and to Marcus Ricci for his service on the Bicycle Safety Commission from January 2004 to August 2008.
Municipal Administrator John Fawcett had no report.
Planning Director Rick Ketzenbarger had no report.
Parks and Recreation Committee Michelle Grigore reported that the committee involved with the aquatic facility design study has held two meetings thus far with the consultant and plant to hold two group meetings in order to gain more community input. The focus group meetings will be held the week of September 8 and a public meeting will be held the week of September 15. Grigore also reported that “Sculpture in the Garden” display will be in place at the Simpson Garden Park through the end of October.
City Attorney Michael Marsh had no report.
Utilities Director Kevin Maynard had no report.
Public Works Director Brian Craft updated Council on current Public Works projects noting that work on Mercer Road has been completed. Craft noted that the installation of the flashing lights at the crosswalks will be installed once all of the equipment has been received.
NEW LEGISLATION
The following new legislation was recommended by the Administration and presented to Council for introduction:
Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and execute a grant agreement upon grant application approval under the Drug Abuse Resistance Education (DARE) Law Enforcement Grants Program.
Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.
Council Member Newlove, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2008 and ending December 31, 2008.
Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to sign a contract with the Bowling Green Police Command Officers Association, and declaring an emergency.
Council Member Newlove, for the Finance Committee, introduced an ordinance certifying unpaid cost of snow removal to the County Auditor for placement on the tax duplicate.
Council Member McOmber introduced ordinance amending and adopting Section 94.02(A) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning collection of refuse by the City.
Council Member McOmber, for the Planning, Zoning and Economic Development Committee, introduced an ordinance accepting annexation of approximately 1.78 acres of land in Center Township, Wood County, Ohio, from Robert W. Maurer, petitioner.

No person without a valid City permit shall collect, convey over any of the streets or alleys of the city, or dispose of any garbage, rubbish, or refuse accumulated in the city.
On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Heminger, McOmber, and Newlove voted yes. Council President Newlove declared motion carried, and Ordinance #7817 amended.

Clerk read Ordinance #7808 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the supplying of annual inventory requirements, vehicle fuel, underground sewer lines and overhead insurance, and the sale of scrap materials for calendar year 2009 for the Municipal Utilities Department, for third reading.
Council Member McOmber moved, Heminger seconded, to adopt Ordinance #7808. On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Heminger, McOmber, and Newlove voted yes. Council President Newlove declared motion carried, and Ordinance #7808 adopted.
Clerk read Ordinance #7809 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the 2008 Conneaut Avenue sewer replacement project, for third reading.

Council Member McOmber moved, Dunn seconded, to adopt Ordinance #7804 amending the Zoning District Map of the City of Bowling Green, Ohio, for approximately 26.3135 acres of land on East Wooster Street, east of the Meijer Store, from A-1 Agricultural to B-2 General Commercial zoning. On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes. Council President Newlove declared motion carried, and Ordinance #7804 adopted.
Council Member Sorrells moved, Heminger seconded, to excuse Council Member Frost from this evening’s meeting. On unanimous voice vote, Council President Newlove declared motion carried.
Council Member Zanfardino moved, Dunn seconded, to adjourn. On unanimous voice vote, Council President Newlove adjourned the August 18, 2008 regular meeting of the City Council at 8:31 p.m., subject to call.
