MONDAY, JULY 7, 2008

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Council Member Dunn was not present.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, and Planning Director Rick Ketzenbarger.  Utilities Director Kevin Maynard was not present.

 

Council President Newlove declared the minutes of the meeting held June 16, 2008 approved as distributed.

 

 

CORRESPONDENCE

 

            There was no correspondence.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn had no report.

 

            Municipal Administrator John Fawcett noted that the Classic Car Show will be held on Saturday, July 12, and reviewed street closures for the event.  Fawcett also noted that interviews will begin this week to fill the Fire Captain position.

 

            Council Member Sorrells commented about proposed legislation from Council Member McOmber regarding picking up refuse on private streets.  Sorrells asked the Administration to provide more information to Council about liability issues of putting city vehicles on private streets and for a financial impact statement for providing that service.  Sorrells indicated that he is particularly concerned about the City’s ability to provide the additional service to residents on private streets without a tax increase or charging refuse pickup fees.  Fawcett responded that the Administration would provide the information and address the impact of the proposed legislation at the next Council meeting.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Director Michelle Grigore reported that the Save the Woods campaign has raised $195,000 towards its goal of $480,000.  Upcoming fundraising events include the annual Wine & Cheese Party and a barn party/auction   being planned for October.  Grigore also reported that funds raised for the Simpson Garden Park has reached $667,000 towards the goal of $700,000.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard was not present.

 

            Public Works Director Brian Craft updated Council on current Public Works projects and noted that curbside brush pickup will begin on Monday, July 14.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution authorizing the filing of (a) proposal(s) and/or (an) application(s) with the Ohio Department of Transportation for grants through the U.S. Department of Transportation Federal Transit Administration (FTA), as authorized under Federal Transit Laws, as codified, 49 USC Section 5311 financial assistance for other than urbanized areas and funds available from the Ohio Public Transportation Grant Program, executing a contract/grant for the FY 2009 Ohio Elderly and Disabled Transit Fare Assistance Program, and executing a contract with the Ohio Department of Transportation upon grant proposal and/or application approval.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance amending and adopting Section 33.03(A) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to pay for school police, interns, and civil infractions hearing officer.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance for cleaning of streets by special assessment.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to sign a contract with the Bowling Green Municipal Employees Association, and declaring an emergency.

 

            Council Member McOmber introduced an ordinance amending and adopting Section 94.02(A) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning collection of refuse by city.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending the Zoning District Map of the City of Bowling Green, Ohio, for approximately 26.3135 acres of land on East Wooster Street, east of the Meijer Store, from A-1 Agricultural to B-2 General Commercial zoning.

 

 

COUNCIL COMMITTEE REPORTS

 

            There were no Council Committee reports.

 

 

LOBBY VISITATIONS

 

            Robert Hudson, 229 Willowood Circle, addressed Council regarding the picking up of refuse on private streets and distributed copies of pictures showing examples of stub streets in developments that require a refuse truck to back up and turn around.

 

 

READING OF LEGISLATION

            Council Member Newlove moved, McOmber seconded, to suspend the rules and give Ordinance #7802 its second and third reading.  On roll call vote, Council Members  Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Ordinance #7802 for second and third reading by number and title only.

 

             Council Member Newlove Heminger seconded, to adopt the emergency clause for Ordinance #7802.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Frost voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Newlove moved, Frost seconded, to adopt Ordinance #7802.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7802 adopted.

            Council Member Frost announced that a public hearing will be held for Ordinance #7804 on August 18, 2008 at 7:45 p.m. in the Council Chamber.

 

            Clerk read Ordinance #7805 amending and adopting Section 94.02(A) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning collection of refuse by city, for first reading.

 

            Clerk read Ordinance #7786  authorizing the Municipal Administrator and the Utilities Director to advertise for bids and enter into a contract or contracts for the supplying and cleaning of uniforms for the Public Works Department and the Utilities Department, for second reading.

 

            Clerk read Ordinance #7787 amending and adopting Section 76.30 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to parking and the payment of fines, for second reading.

 

            Council Member Newlove moved, Frost seconded, to amend by substitution to change the fine in Section A from $10.00 to $5.00.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7787 amended by substitution.

 

            Clerk read Ordinance #7788 amending and adopting Section 76.23(C)(3) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to parking permits, for second reading.

 

            Clerk read Ordinance #7789 authorizing the Municipal Administrator and the Utilities Director to seek proposals and enter into a contract or contracts for banking services, for second reading.

 

            Clerk read Ordinance #7791 accepting a utility easement from the Board of Education of the Bowling Green City School District for property located along Fairview Avenue, for second reading.

 

            Clerk read Ordinance #7792 authorizing the Utilities Director to execute an agreement(s) for the purchase of the AquaDisk Filtration System from Aqua-Aerobic Systems, Inc., for second reading.

 

            Clerk read Ordinance #7793 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the demolition of sand filters and installation of tertiary filter improvements at the Wastewater Treatment Plant, for second reading.

 

            Clerk read Ordinance #7794 authorizing the Utilities Director to apply for a loan and execute an agreement with the Ohio EPA Water Supply Revolving Loan Account and/or the Ohio Water Development Authority for the design, purchase and construction of tertiary filter improvements at the Wastewater Treatment Plant, for second reading.

  

            Clerk read Ordinance #7795  authorizing the Utilities Director to execute an agreement with Poggemeyer Design Group for engineering design services for the Water Pollution Control facility’s 30 MGD ultraviolet disinfection and Parshall Flume improvements to be integrated with the tertiary filter design in an amount not to exceed $75,000, for second reading.

 

            Clerk read Ordinance #7796  amending the Zoning District Map of the City of Bowling Green, Ohio, for approximately 15.45 acres of land located generally on East Newton Road from M-3 to B-2 Commercial zoning, for second reading.

 

            Clerk read Ordinance #7797 approving the S-District Site Plan for the building addition and the parking addition at Heritage Corners on Klotz Road, for second reading.

 

            Clerk read Ordinance #7798 amending and adopting Section 150.41(K) and (L) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning determination of significant trees in Planned Overlay Development Districts, for second reading.

 

            Clerk read Ordinance #7799 amending and adopting Sections 151.37 and 151.45 and 151.46 of the Codified Ordinances of the City of Bowling Green, Ohio, concerning easements, for second reading.

 

            Clerk read Ordinance #7800  authorizing the grant of easement for an existing driveway to Melvin Baker and Gladys Baker for their lifetime, for second reading.

 

            Clerk read Resolution #3365  adopting the Estimate of Revenues for the year 2009, for third reading.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Resolution #3365.  On roll call vote, Council Members Sorrells, Zanfardino, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Resolution #3365 adopted.

 

            Clerk read Ordinance #7785  accepting easements from Bowling Green Covenant Church, Bowling Green Christian Academy, and Robert and Patricia Maurer for a pedestrian and bicycle pathway on Haskins Road, for third reading.

 

            Council Member Heminger moved, Frost seconded, to adopt Ordinance #7785.  On roll call vote, Council Members Zanfardino, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7785 adopted.

 

            Council Member Zanfardino moved, Sorrells seconded, to excuse Council Member Dunn from this evening’s meeting.  On unanimous voice vote, Council President Newlove declared motion carried.

 

            After some discussion regarding the relevancy of the motion made at the last Council meeting regarding the Administration’s position on the acceptance of private streets as public, Council President Newlove withdrew the motion.

 

Council Member McOmber moved, Frost seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the July 7, 2008 regular meeting of the City Council at 8:30 p.m., subject to call.
